| Each telecommunications provider serving Colorado customers must apply for and receive from the PUC Telecommunications Section a CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY (“CPCN”) and a CERTIFICATE OF OPERATING AUTHORITY to operate in Colorado. The PUC provides oversight over entry and exit from the Colorado market for telecommunication services. The PUC issues certificates of operating authority to identify the specific market areas and specific services offered by each company. In addition, the PUC grants letters of registration to companies providing emerging competitive intrastate services including providers of long-distance telecommunication services and non-optional operator service providers.

| Phone cards which value your credit in dollars, i.e., you prepay $20 and have $20 of calling credit, are simply credit cards, and have no impact on the sales tax because the tax can be charged against the $20 of the card value. |
| Phone Cards which value your credit in anything other than dollars, particularly minutes, are taxable as the sale of telephone service. This is because the sales tax cannot be charged to the card value. Providers of these cards are making a sale of telephone service, and thus the tax must be collected on the sale. |
| Any products sold over the phone are subject to Colorado Sales Tax if sold to customers in Colorado. |
