The Colorado Department of Agriculture (CDA) enforces the Colorado Fertilizer Law to promote truth and fairness in the sales of fertilizers, soil conditioners, plant amendments and compost.  Agricultural and horticultural producers, professional landscapers and gardeners are protected from the sale of adulterated and misbranded products.

 

The CDA Fertilizer Program registers products and reviews label claims for completeness & accuracy.  Inspection, sampling and analysis of products are conducted to verify nutrient and active ingredient claims, and to ensure that adulterants such as high levels of Salmonella, coliform bacteria and heavy metals are not present.  Tonnage and poundage fees are required by law and collected to fund Fertilizer and Groundwater Protection Program efforts.

 

Registration:  Products must be registered yearly (July thru June).

Tonnage:  A distribution & groundwater fee & report are due yearly (January thru December).

Analysis:  Plant nutrient and other required guarantees must be met when a product sample is analyzed.

Labels:  Plant nutrient, active ingredient and other claims must be true and complete.

The manufacturing and packaging of fertilizer may release chemical and solvent emissions into the air.
If the emission is above specified levels, Air Pollution Emission Notice (APEN) is required. $119.96 filing fee, $59.98/hr evaluation fee. Requires final approval and ongoing inspections Annual fee based on emissions.
All fertilizer manufactures and packagers should contact the Small Business Clean Air Technical Assistance Program to determine if they are subject to APEN requirements.

Fertilizer purchased by an agricultural producer is not subject to tax. "Fertilizer" includes compounds of nitrogen, phosphorus, potassium, trace elements or similar materials or substances which provide essential plant food elements and which become ingredients of the growing plant. "Fertilizer" does not include soil, sand, peat moss, limestone, mulches and similar materials primarily used to condition the soil or to preserve or facilitate plant growth, regardless of incidental nutritive value; therefore, purchases of such things are taxable. Compost

The Colorado Department of Agriculture (CDA) enforces the Colorado Fertilizer Law to ensure that compost offered for sale in Colorado is actually mature and unadulterated compost.  Agricultural and horticultural producers, professional landscapers and gardeners depend on compost and other organic-based products to condition soil, retain crop nutrients where they are needed, and minimize nutrient waste and runoff that can negatively impact Colorado’s environment.

The CDA Fertilizer Program registers commercial composting facilities, oversees sampling and analysis of compost products to verify maturity and to ensure no adulterants are present, and ensures that basic compost product label requirements are met.

 

  • Registration fee:  Colorado commercial compost facilities must be registered yearly (January thru December) with the CDA if not registered by the Colorado Department of Health and Environment.
  • Analysis:  Maturity is verified through the testing of ammonia, carbon dioxide, and the carbon/nitrogen ratio.  Allowable limits are set on heavy metals, Salmonella and coliform bacteria.
