| Private applicator certification required to apply restricted-use pesticides for the purpose of producing any agricultural commodity on property owned or rented by the applicator or his employer. Dealers of restricted-use pesticides must register with the EPA. Commercial applicators must register with Colorado Dept. of Agriculture. |
| Certification and training regulations require pesticide applicators to meet certain training and/or testing requirements before they use or supervise the use of pesticides labeled "restricted use." In addition, the pesticide label indicates how a pesticide may be used and what protective clothing or other measures may be necessary for maintaining worker safety.

| Certain biological pest control agents are seasonally available from the Colorado Dept. of Agriculture to help suppress weed and insect pests in the State. They can be requested by private landowners in the State, or other governmental agencies concerned with controlling the spread of exotic invaders. The insects are free of charge, but supplies can be limited and vary from one year to the next.

| Any person who utilizes chemigation must file with the Colorado Department of Agriculture, Division of Plant Industry, an application for a chemigation permit for each irrigation system utilizing chemigation. Chemigation is the process whereby agricultural chemicals (pesticides and fertilizers) are applied to land or crops in or with water through a CLOSED irrigation system. Inspections may be conducted of permitted systems once every two years. Inspections are conducted to assure proper installation and maintenance of equipment as required by the Chemigation Act (35-11-113, C.R.S.) Annual permit fee is $45; inspection fee is $40.

| Pesticide appicators must attempt to notify any person on the Department of Agriculture's "Registry of Pesticide-Sensitive Persons" at least 24 hours before any turf or ornamental pesticide applications are made to any property abutting a registered person's property. (35-10-112, C.R.S.)

| Purchases of pesticides or other substances registered by the Colorado Commissioner of Agriculture as agricultural use pesticides under the Pesticide Act are exempt from state sales and use tax and any special district sales tax when purchased from a licensed dealer.
